High-ranking city official charged with felony

PIQUA — An investigation by the Miami County Sheriff’s Office has resulted in a felony charge being filed against Piqua Street Department Superintendent Doug Harter.

One count of unauthorized use of property, a felony of the fifth-degree, was filed March 6 against Harter, who is now scheduled to appear before a municipal court judge at his arraignment at 8 a.m. on March 24.

Authorities state Harter, 44, allegedly used a home computer to access a personal e-mail account of his ex-wife, Rene D. Stiteler, on at least 10 occasions without her consent between March and June 2007 and copied e-mails that referenced him.

Stiteler learned of the alleged crime after Harter’s attorney brought it to her attention. Harter is alleged to have provided copies of those e-mails — the contents of which remain unknown — to the attorney, one sheriff’s report claims.

At the time, Harter and Stiteler were in a custody battle involving the couple’s teen-aged daughter, those further state.

When contacted by phone early Tuesday afternoon, Harter said he had no comment.

If convicted as charged, Harter faces up to one year in prison and a $2,500 fine.

The charge was filed against Harter shortly following a Feb. 26 interview between a sheriff’s deputy and the top street department official at his city residence. During that interview, Harter “admitted to accessing Mrs. Stiteler’s private e-mail account on at least 10 occasions,” Deputy Robert Morando wrote in a supplemental report.

Harter was able to access the e-mail account directly through a shortcut Harter’s daughter placed on his home computer, the reports add.

Piqua City Manager Fred Enderle said the felony charge was brought to his attention two weeks ago by Harter, who remains working for the city.

“At this point in time it is not a concern of the city,” Enderle said.

Enderle said a decision with Harter’s employment would only come once the case is resolved in the court system.

Hired in December 1999, Harter makes $1,315.08 per week, or $68,384.16 annually, city records show.

Harter is one of four street department employees who are suing the 15 winners of the $207 million jackpot they won in December after pooling their money together. A majority of the winners are Harter’s former employees.
